Recruitment Privacy Notice

LeadDesk Plc and its affiliates (“LeadDesk”, “we” or “us”) are committed to protecting the privacy of its job applicants and potential candidates (“you”).

In this Recruitment Privacy Notice we describe how we process your personal data as a job applicant or potential candidate of LeadDesk. From this Recruitment Privacy Notice you can learn what data we process of you, how we collect it, how long we store it, what your rights are as a data subject and to who we disclose your data to.

1. Controller of your personal data

The data controller is the LeadDesk group company with whom you are interacting. The contact details of LeadDesk’s offices may be found at: https://leaddesk.com/about-us/contact-us/.

2. Purpose for processing

We process your personal data for the following purposes:

  • To communicate with you about our open positions.
  • To communicate with you about your job application and potential future job opportunities.
  • To consider your application in respect to the role you have applied for and possible other open roles at LeadDesk.
  • To comply with applicable laws and other regulatory requirements.
  • In case you have been referred to us as a candidate by our recruitment partner, to help our recruitment partners improve their services.

3. Legal bases for processing

We process your personal data based on the following legal purposes:

  • Legitimate interest – our legitimate interests to execute our business activities, to reach candidates from different sources, to ensure your suitability for any open role or to defend possible legal claims.
  • Consent – we may collect data related to you from external sources (such as reviews from former colleagues and aptitude tests) and retain your data for future recruitment processes based on your consent.
  • Contract – If we both agree that we are the perfect match, we may process your personal data to form an employment contract.

4. Types of data we process

We collect and process various types of personal data during a recruitment process, e.g.:

  • Contact details – such as name, address, email address and phone number
  • Identification data – such as social security number, date of birth, gender
  • Competence information – such as CV, references, employment history, qualifications, education data
  • Other information that you have provided to us – including any information provided to us in your resume, CV, application and interview process.
  • Other information relevant to the recruitment process – including possible aptitude test results, reviews of earlier work performance, and in some positions also background checks (security clearance).

5. Sources of personal data

The personal data we process about you comes from different sources:

  • You – we receive information directly from you, during the recruitment process and during your employment
  • Third parties – we can receive information from third parties, such as our recruitment partners, referees or authorities.

6. Data disclosures and data processors

As a general rule, we do not disclose your personal data to any third parties outside of LeadDesk. However, we do reserve the right to transfer your personal data to third parties who provide services to LeadDesk, such as IT service providers. These third-party service providers may process your personal data on LeadDesk’s behalf and are therefore considered as processors of personal data.

Before disclosing any personal data to such third parties, we always ensure that we have sufficient data processing agreements in place with our processors and that they are acting according to our instructions. If we transfer your personal data outside the
EU/EEA or to a country not subject to an adequacy decision by the EU Commission, we make sure that necessary safeguards are in place, such as the Standard Contractual Clauses (SCC) approved by the EU Commission.

We may also disclose your personal data if we have consent to do so.

7. Data retention periods

We store your personal data for the duration of the recruitment process and for one (1) year thereafter. If we want to retain your data for longer, we will ask for your consent to do so. We may also retain your consent to use your personal data in future recruitment processes.

8. Securing your personal data

We use appropriate technical and organisational measures to protect the security and integrity of your personal data. We have implemented access controls, firewalls and network intrusion detection systems. We educate and regularly train all employees and managers who process your personal data. When using third-party processors, we require them to have similar security controls in place.

9. Your rights and how to exercise them

In addition to what is stated in this Recruitment Privacy Notice, you have the following rights as a data subject:

  • Right of access, rectification and erasure – You have the right to request access to the personal data we process of you. Upon a written request from you, we will also rectify any outdated, inaccurate or incomplete personal data. You also have the right to request your data to be erased (right to be forgotten) in accordance with applicable legislation.
  • Right to data portability – You have the right to receive your personal data in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller when we process your data automatically and based on a contract or your consent.
  • Right to object and right of restriction – You have the right to object to processing we carry out based on legitimate interest on grounds relating to your particular situation, unless we have compelling legitimate interests for the processing which override those interests. You also have the right to request the restriction of the processing of your personal data, for instance, if you object to processing as described above or contest the accuracy of your personal data.
  • Right to withdraw consent – You have the right to withdraw your consent at any time. Please note that withdrawing your consent does not affect the legality of the processing we have carried out prior to the withdrawal.
  • Right to lodge a complaint – You have the right to lodge a complaint with the relevant supervisory authority in case you feel that we have processed your personal data contrary to this Recruitment Privacy Notice or the applicable legislation.

10. Automatic decision-making and profiling

There is no automated decision-making or profiling related to the processing of your personal data.

11. Changes to this Recruitment Privacy Notice
